TERMS OF SERVICE.

These Terms of Service ("Terms") are a binding agreement between you and Physique Revival ("Physique Revival," "we," "us," or "our") governing your access to and use of our websites, landing pages, funnels, applications, booking pages, content, communications, and coaching services (collectively, the "Services").

By accessing the Site, submitting a form or application, booking a call, purchasing a program, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

You represent that you are at least 18 years old and have the legal capacity to enter this agreement.

Physique Revival provides online coaching in training, nutrition, and lifestyle habits, delivered through consultations, check-ins, app-based programming, messaging, and educational content. Program structure, duration, deliverables, and pricing are custom and are confirmed in writing at the time of enrollment.

Submitting an application or booking a consultation does not create a coaching relationship or guarantee acceptance into any program. We reserve the right to decline any applicant for any lawful reason.

We may modify, suspend, or discontinue any part of the Services at any time without liability.

When you submit a form or book a call, you agree to provide accurate, current, and complete information and to keep it updated. Providing false information may result in refusal or termination of service.

By submitting your information you expressly consent to receive calls (including autodialed, prerecorded, artificial-voice, and AI-voice calls), SMS/MMS text messages, ringless voicemail, emails, direct messages, and postal mail from Physique Revival and our marketing partners, at the numbers and addresses you provide, even if those numbers or addresses appear on any do-not-call, do-not-contact, or do-not-email list or registry. Consent is not a condition of purchase. Message and data rates may apply; message frequency varies. Reply STOP to opt out of texts, HELP for help, or use the unsubscribe link in emails. Full details are in our Privacy Policy.

Consultations may be recorded for quality, training, and compliance purposes. By joining a call you consent to that recording.

Fees, payment schedules, and program terms are disclosed before enrollment and confirmed in your coaching agreement or checkout page. By enrolling you authorize us and our payment processors to charge your selected payment method for the full program amount, including any installment or recurring payments, until the agreed term is paid in full.

Installment plans represent a commitment to the total program price, not a month-to-month subscription, unless expressly stated otherwise. Failed, disputed, or reversed payments may result in immediate suspension of Services, late fees, and collection efforts, and you remain responsible for the outstanding balance and reasonable collection costs.

Except where required by law or expressly stated in your coaching agreement, all payments are non-refundable because coaching capacity, custom programming, and coach time are reserved for you at enrollment. Initiating a chargeback without first contacting us to resolve the issue is a breach of these Terms.

Prices may change at any time; changes do not affect programs already purchased.

You are responsible for following your program safely, communicating honestly about your health and progress, and using equipment and facilities appropriately. You agree not to misuse the Services, harass our staff or clients, resell or share program materials, scrape or reverse-engineer the Site, or use the Services for any unlawful purpose.

We may suspend or terminate your access, without refund, for abusive conduct, non-payment, or breach of these Terms.

Physique Revival is not a medical provider. Our coaches do not diagnose, treat, cure, or prevent any disease or medical condition, and nothing in the Services constitutes medical, psychological, or nutritional-therapy advice. Consult your physician before starting any exercise, nutrition, or supplementation program, especially if you have or suspect any medical condition, are pregnant, or are taking medication.

Exercise and dietary change carry inherent risks, including injury and, in rare cases, serious harm or death. You voluntarily assume those risks and agree to stop immediately and seek medical attention if you experience pain, dizziness, or other symptoms.

Results shown on our pages — including testimonials, transformation photos, case studies, and videos — reflect individual experiences and are not typical or guaranteed. Your outcome depends on your starting point, genetics, adherence, effort, health status, and other factors outside our control. We make no guarantee of any specific physical, health, financial, or performance result.

Testimonials appearing on the Site are from real clients and are used with permission. Some clients may have received an incentive, discount, or compensation for sharing their story. Where a program was provided at a reduced rate in exchange for a testimonial, that relationship exists as disclosed. Testimonials are not a promise of similar results.

All content on the Site and within the Services — including programming, templates, curricula, videos, text, graphics, logos, and the Physique Revival name and marks — is owned by us or our licensors and protected by intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use purchased materials for your personal, non-commercial use during your enrollment. You may not copy, distribute, publish, resell, coach from, or create derivative works from our materials without written permission.

If you submit photos, videos, reviews, or other content to us, you grant Physique Revival a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, and display that content for marketing and promotional purposes, unless you revoke permission in writing (revocation applies prospectively only).

The Services rely on and may link to third-party providers for scheduling, forms, payments, video hosting, messaging, and analytics. We are not responsible for the availability, content, security, or practices of third-party services, and your use of them is governed by their own terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RESULT WILL BE ACHIEVED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHYSIQUE REVIVAL AND ITS OWNERS, COACHES, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Physique Revival and its owners, coaches, employees, contractors, and affiliates from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising from your use of the Services, your breach of these Terms, your violation of law, or any injury or condition resulting from your participation in a training or nutrition program.

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the greatest extent permitted by law.

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

You and Physique Revival agree to first attempt to resolve any dispute informally by contacting support@physique-revival.com and allowing thirty (30) days to resolve the matter.

If the dispute is not resolved, any claim arising out of or relating to these Terms, the Services, or any communications you received from us or our partners — including claims under the Telephone Consumer Protection Act and similar statutes — will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.

YOU AND PHYSIQUE REVIVAL WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to the arbitration provision, venue for any permitted court action lies exclusively in the state or federal courts located in Florida.

If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver.

These Terms, together with the Privacy Policy and any coaching agreement you sign, constitute the entire agreement between you and Physique Revival regarding the Services. You may not assign these Terms; we may assign them freely.

We may update these Terms at any time. The updated version takes effect when posted, and your continued use of the Services constitutes acceptance.
